Terms of Use

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS WHEN USING Homeilove.co.uk (“this Site”) or our mobile apps.

1.1 HomeiLove.co.uk and the HomeiLove name, logos and associated branding are owned and operated by HOMEILOVE LIMITED, a company registered in England and Wales under company number 15647848 (“HomeiLove”, “we”, “us” or “our”).

1.2 These Terms of Use (“Terms”) apply to your use of our website, mobile applications and associated online services. Our Privacy Policy and Cookie Policy apply separately to the collection and use of personal information and cookies. They do not form part of these Terms unless expressly stated otherwise.

1.3 By accessing or using this Site or our mobile apps, you agree to comply with these Terms. If you do not agree to these Terms, you must not use the Site or our mobile apps. References to “you” or “your” mean the person accessing or using our services.

1.4 HomeiLove provides an online property platform through which users may search for, advertise, promote, enquire about and otherwise interact with property-related listings and services. Our platform may include residential property, commercial property, farms, land and other property-related opportunities.

1.5 Unless expressly stated otherwise, HomeiLove is a platform provider and is not the owner, seller, landlord, tenant, buyer, developer, estate agent, letting agent, mortgage adviser, contractor or other party to any transaction between users or advertisers. A property transaction or other agreement you enter into with another user or advertiser is separate from your agreement with HomeiLove.

1.6 These Terms constitute a legally binding agreement between you and HomeiLove concerning your use of the Site and our services. We may update these Terms from time to time where reasonably necessary, including to reflect changes in our services, legal requirements or regulatory requirements. The updated version will be published on the Site and, where appropriate, we may notify registered users of material changes.

1.7 You should read these Terms carefully and keep a copy for your records. Your continued use of the Site after updated Terms have been made available will constitute acceptance of the updated Terms to the extent permitted by applicable law.

1.8 Certain uses of the Site are prohibited and may amount to misuse of our systems or services. Please refer to clause 3 for further details.

2.1 The copyright and all other intellectual property rights in this Site and our mobile apps, including database rights, trade marks, service marks, trading names, text, graphics, photographs, software, source code, files, layouts and links, belong to us or our licensors. All such rights are reserved.

2.2 Subject to these Terms, you may access and use material made available through the Site solely for your personal or legitimate business use of the Site. You must not copy, reproduce, transmit, modify, republish, distribute, commercially exploit, store, frame, mirror, scrape or create derivative works from any substantial part of the Site or its content without our prior written permission, except where permitted by law.

2.3 The HomeiLove name, logos, trade marks and other branding must not be copied, reproduced, modified or used in a manner that suggests an association, approval or endorsement by HomeiLove without our prior written consent.

2.4 This Site may contain links to websites, applications or services operated by third parties. We do not control those third-party services and are not responsible for their content, availability, security, policies or practices. A link does not constitute an endorsement or recommendation by HomeiLove. If you access a third-party website or service, you do so at your own risk and subject to its own terms and policies.

2.5 HomeiLove is not an estate agency or letting agency and does not itself sell, let, purchase or manage the properties advertised through the Site, unless expressly stated otherwise for a particular service. Property details and other listing information may be supplied by property owners, sellers, landlords, estate agents, letting agents, developers, brokers, businesses and other third-party advertisers (“Property Advertisers”).

2.6 We may carry out certain checks, including account, email, telephone, identity, business or listing checks, where we consider appropriate. However, any verification or verification badge does not constitute a guarantee, recommendation or confirmation that a user, advertiser, property, listing, title, ownership interest, price, condition, planning position, tenancy position or other information is accurate, lawful or suitable.

2.7 You should independently verify all material information before making an offer, entering into a tenancy, purchasing a property, paying money, exchanging contracts or otherwise relying on information displayed through the Site. You should obtain appropriate professional advice, including legal, financial, mortgage, surveying, valuation, planning or tax advice where appropriate.

3.1 You are responsible for ensuring that your device, internet connection and software meet the technical requirements necessary to access and use the Site and our mobile apps.

3.2 You must not misuse our systems or the Site. In particular, you must not hack into, circumvent security, interfere with or disrupt the operation of our systems or services, or attempt to do so. This includes introducing viruses, trojans, worms, logic bombs, ransomware or other material that is malicious or technologically harmful.

3.3 You must not use or attempt to use automated programs, bots, crawlers, spiders, scrapers or similar tools to access, copy, collect, monitor or reproduce content or data from the Site except where such activity is expressly authorised by us in writing or permitted by applicable law.

3.4 You must not use the Site to obtain information for the purpose of creating or operating a competing property database, property portal or substantially similar service, except where expressly permitted by law.

3.5 You must not use enquiry forms, contact forms, messaging systems or other communication features for spam, unsolicited marketing, phishing, fraud, harassment, abuse or any other improper purpose. Any enquiry you submit must be genuine and relevant to the property or service concerned.

3.6 You must not knowingly provide false, misleading, incomplete or fraudulent information when creating an account, submitting a listing, contacting another user or using any feature of the Site.

3.7 You must not use the Site to advertise property or services that you do not have the authority or lawful right to advertise.

3.8 You must not use the Site for any unlawful purpose or in breach of any applicable law or regulation, including laws relating to fraud, consumer protection, discrimination, privacy, intellectual property, financial crime, money laundering or property transactions.

3.9 You must not establish a link to this Site in a manner that suggests an association, approval or endorsement by HomeiLove where none exists. You must not frame or reproduce the Site within another website or service without our prior written consent.

3.10 You must not upload or use threatening, abusive, defamatory, obscene, hateful, discriminatory, fraudulent or otherwise unlawful language or content in any communication, form, listing, review, message or email submitted through the Site.

3.11 Whenever you use features that allow you to upload content or communicate with other users, you must comply with clause 4. You are responsible for ensuring that anything you submit complies with these Terms and applicable law.

4.1 You retain ownership of intellectual property rights in content that you lawfully own and upload to the Site. By uploading or submitting content, you grant HomeiLove a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, display, distribute and otherwise use that content as reasonably necessary to operate, provide, improve, promote and protect our services.

4.2 The licence in clause 4.1 will continue for as long as the relevant content is available through our services and for a reasonable period afterwards where necessary for technical, legal, security, backup or record-keeping purposes. This does not transfer ownership of your content to us.

4.3 You confirm that you have all rights, permissions and authority necessary to upload and licence the content you submit to HomeiLove, including photographs, videos, descriptions, floor plans, logos, documents and other materials.

4.7 We may review, moderate, restrict, edit, refuse to publish, remove or disable access to content where we reasonably consider this necessary to comply with law, protect users, protect HomeiLove or third parties, enforce these Terms, investigate suspected fraud or abuse, or maintain the integrity and quality of the Site.

4.8 Where appropriate, we may contact you to request clarification or evidence concerning content, an account, a property listing or an alleged breach of these Terms.

4.9 Where we reasonably believe that a breach of these Terms or applicable law has occurred, we may take appropriate action, including:

5.1 Some features of the Site may require you to create an account. When registering, you must provide information that is accurate, complete and kept up to date.

5.6 We reserve the right to refuse an account application where we reasonably consider that doing so is necessary to protect HomeiLove, our users, third parties or the integrity of the Site.

6.1 We may suspend, restrict or terminate your access to the Site or any part of our services where we reasonably believe that you have breached these Terms, applicable law, our policies or the rights of another person, or where such action is reasonably necessary to prevent fraud, abuse, security risks or harm to users or HomeiLove.

6.2 Where appropriate and where it is reasonably practicable to do so, we will notify you of the reason for a suspension, restriction or termination. We may not provide advance notice where doing so would create a security, fraud, legal or operational risk.

6.3 If your access is suspended or terminated, you must not attempt to circumvent the restriction by creating another account or using another person's account without our permission.

6.4 Suspension or termination does not affect rights or obligations that arose before the suspension or termination or any provisions of these Terms which are intended to continue afterwards.

7.1 We take reasonable steps to maintain the security and availability of our Site. However, because online services depend on the internet, telecommunications networks and third-party infrastructure, we cannot guarantee that the Site will always be available, uninterrupted, secure or error-free.

7.2 We may from time to time suspend, withdraw, modify or discontinue all or part of the Site or any feature where reasonably necessary for maintenance, security, development, legal compliance or other legitimate operational reasons.

7.3 The information provided through the Site is generally provided for information and property-search purposes and does not constitute legal, financial, mortgage, investment, valuation, surveying, planning, tax or other professional advice.

7.4 We do not guarantee that property information, prices, photographs, descriptions, availability, measurements, locations, tenure information, planning information, rental information or other listing information supplied by third parties is accurate, complete, current or suitable for your circumstances.

7.5 Property listings may change or become unavailable without notice. A property appearing on the Site does not guarantee that it remains available or that any particular price, term or feature will continue to apply.

7.6 You should independently verify information with the relevant Property Advertiser and obtain appropriate professional advice before making any financial or legal commitment.

7.7 Nothing in these Terms excludes or limits any statutory rights or protections that cannot lawfully be excluded or limited, including any rights you may have under applicable UK consumer protection legislation.

8.1 Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

8.2 If you are a consumer, nothing in these Terms affects your statutory rights or our obligations under applicable consumer protection law. In particular, where we provide services to you as a consumer, we will provide those services with reasonable care and skill to the extent required by applicable law.

8.3 Subject to clauses 8.1 and 8.2, we are not responsible for losses caused by circumstances outside our reasonable control, including failures of telecommunications networks, internet infrastructure, hosting providers, third-party services, power supplies, cyber incidents or other events which we could not reasonably prevent or control.

8.4 We are not responsible for the acts, omissions, representations, conduct, financial position, solvency, suitability or reliability of Property Advertisers or other third parties using the Site.

8.5 We are not a party to any contract, transaction, tenancy, sale, purchase, mortgage, development agreement, service agreement or other arrangement entered into between you and another user or Property Advertiser unless we expressly state otherwise.

8.6 To the extent permitted by applicable law, we are not responsible for loss or damage arising from your reliance on information supplied by third parties through the Site, including property descriptions, prices, photographs, availability, measurements, statements about ownership or authority, planning information or other listing information.

8.7 If you are a business user, subject to clauses 8.1 and 8.3, we will not be liable for indirect or consequential loss or for loss of profit, revenue, business, anticipated savings, goodwill or reputation, or loss or corruption of data, except to the extent that such loss cannot lawfully be excluded.

8.8 If you are a consumer, we will not exclude or limit liability for losses that cannot lawfully be excluded or limited. We will not, however, be responsible for losses that are not reasonably foreseeable or that arise from your misuse of the Site or failure to follow reasonable instructions or security measures, to the extent permitted by law.

8.9 We use reasonable measures to protect our Site and systems, but no online service can be guaranteed to be completely secure. You should use appropriate security measures on your own devices and accounts.

8.10 When you use contact forms, enquiry forms or other communication features to contact a Property Advertiser, information you submit may be passed to that Property Advertiser so that they can respond to your enquiry. Once information has been shared with a third party, that third party may contact you directly in accordance with applicable law and its own privacy obligations. Please refer to our Privacy Policy for further information about how your personal data is handled.

9.2 If you have registered for an account or otherwise provided us with an email address, we may send notices and service communications to that email address where appropriate.

9.4 Where we are required by law to give you a notice in a particular manner or within a particular period, we will comply with those requirements. Otherwise, electronic notices will generally be treated as received when they are sent, provided we do not receive an automated notification that delivery has failed.

10.2 Feedback, reviews and ratings submitted through the Site should reflect your genuine experience or opinion. You must not submit fake reviews, manipulate ratings, submit reviews on behalf of another person without authority, or offer or accept incentives intended to create misleading reviews or ratings.

10.3 We may moderate, refuse to publish or remove reviews, feedback or other content where we reasonably believe that it is false, misleading, unlawful, abusive, fraudulent, irrelevant or otherwise breaches these Terms or applicable law.

10.4 Calls directed to or from our advertisers, including third-party estate agents, letting agents, developers and other Property Advertisers, may be recorded or monitored where permitted by applicable law for training, quality, security, compliance and service-improvement purposes. Where required, appropriate notice will be provided.

11.1 We may change, update, suspend or discontinue any aspect of the Site or our services from time to time. Where a change materially affects your rights or obligations, we will provide appropriate notice where reasonably practicable.

11.2 We may revise these Terms from time to time. The latest version will be published on the Site. If you continue to use the Site after revised Terms take effect, the revised Terms will apply to your future use of the Site, subject to any rights you have under applicable law.

11.3 If you are a business user, these Terms constitute the agreement between you and us concerning your use of the Site, together with any additional terms expressly agreed between you and us for particular services. You acknowledge that you have not relied on any representation not expressly set out in these Terms, except in the case of fraud or fraudulent misrepresentation.

11.4 If any provision of these Terms is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

11.5 A failure or delay by us in exercising any right or remedy under these Terms does not constitute a waiver of that right or remedy. A waiver of any particular breach does not constitute a waiver of any subsequent breach.

11.6 You may not transfer, assign or otherwise deal with your rights or obligations under these Terms without our prior written consent, except where applicable law permits you to do so. We may transfer or assign our rights and obligations where reasonably necessary in connection with a business reorganisation, sale, merger or transfer of our business, provided this does not adversely affect your statutory rights.

11.7 These Terms are governed by the laws of England and Wales.

11.8 If you are a consumer, you may bring proceedings in respect of these Terms in the courts of the part of the United Kingdom in which you live where applicable, and nothing in these Terms affects any mandatory rights you may have under the law applicable to you.

11.9 If you are a business user, the courts of England and Wales shall have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms, unless we agree otherwise in writing.

11.10 Nothing in these Terms creates a partnership, agency, joint venture, employment relationship or fiduciary relationship between you and HomeiLove.

11.11 These Terms are intended to operate alongside our Privacy Policy, Cookie Policy and any additional terms that apply to specific paid services, advertising packages or other products offered by HomeiLove. If additional terms apply to a particular service, those terms will be made available to you before you purchase or use that service.
